The National Tertiary Education Union represents General and Academic Staff at the University of Tasmania. The Union is a party to the bargaining agreements that cover all General, Academic and English Language Centre Staff, and offers advice to members about pay and conditions. The Union is active in pursuing professional and intellectual issues in higher education, as well as in protecting the rights and interests of its members.

Collective Bargaining

Dear Member,

The NTEU Tasmanian Division Council has voted to lift all current workplace bans, effective 9:00 am, Monday November 23, 2009. The offer of 3-year agreements does represent a major concession from UTAS management, considering that as recently as a week ago they were still promoting a 7-month roll-over of the agreements. By lifting our bans, we aim to facilitate a positive environment for good faith negotiations. 

The quantum of the pay offer is unfortunately inadequate - well below the 16 to 20 percent increases (by mid-2012) being offered at other tertiary institutions.   We are hopeful that through dialogue and negotiation over the summer we can achieve an outcome that will assist in rewarding and retaining existing staff, as well as enabling UTAS to continue to attract new staff including people from interstate and overseas.

We would like to thank all our members who have supported the NTEU this year. A special thanks to the new members who have joined this year to make the Tasmanian Division the greatest membership growth in the country for 2009!

NTEU will shortly hold a series of members’ meeting to discuss the progress of bargaining and to celebrate our role in representing staff at UTAS. We feel that we have made a real difference this year. Please look out for the email inviting you to one of these events.

Members' meetings are being held on Thursday 11 March to provide updates about the collective bargaining negotiations to date.

The meeting will be conducted via videoconference between Sandy Bay and Newnham campuses.

The NTEU Tasmanian Division office has seen a significant increase in the number of cases related to workplace bullying at UTAS.

UTAS are required to provide a workplace that is free from all forms of bullying and harassment and has policies and procedures to ensure this occurs.

The sad reality is that these policies and procedures are not being followed by some managers and supervisors indicating that bullying in the workplace is deeply ingrained into the UTAS culture.

Workplace bullying must stop, if you are or have been bullied or are aware of bullying occuring in your workplace, you should -

  • Make a written record of the incident(s)
  • Complete an incident report and lodge it with UTAS Human Resources
  • Contact the NTEU Division office or your nearest Division Councillor.

Don't tolerate bullying, you have a right to a workplace that is free from bullying and harassment.

Education Faculty Workloads Dispute

 

During 2009, and following a ruling in the AIRC last year, the Faculty of Education has been trialling a revised workload designed to provide a holistic , transparent and equitable method to determine academic workloads. It centres around calculating time for a range of academic activities including teaching, research and administrative aspects . The model incorporates 40%- 40%- 20% split for teaching-research- and admin/community activities to ensure balance and protect staff from excessive teaching. Prior to this, the faculty management, supported by senior university management had tried to impose a workload allocation model based on n 80% teaching.

As a trial, the evaluation of the model is progressing well. Recently the Faculty was able to develop a complete summary of the academic work going on in the Faculty, that summarised the teaching, research and other duties people perform. This summary document has proved to be very useful for the faculty management as planning information because it helps to identify resource gaps and potential staff overload. While the figures need to be further analysed and refined, the early indications are that the Faculty is seriously under resourced and there is evidence of many staff being overloaded. This identifies academic workload as a OH&S issue which UTAS will have to address.

During the remainder of 2009, the model will be refined based on feedback. The workload allocation process should result in all staff having a complete picture of the full range of their work for 2010 before the end of 2009 and is to be fully integrated with performance management. This in itself will be a significant improvement in a faculty dogged by crisis management over recent years. In short we have made great strides, but there is still a way to go. We hope that 2010 will finally bring a just and equitable workload allocation process to the Faculty, only four years after one was supposed to be in place.

The use of a time based-model, as outlined in the EBA was something that many academics were dubious about initially, but our experience shows, if it is properly designed, it can be a good way to account for the complexities of academic work and to enable meaningful discussion to introduce truly flexible and transparent processes around the allocation of work. After going through all this pain, and seeing the benefits starting to flow, we would be very reluctant to go back to something as ill-defined as an outputs based model as proposed by UTAS management.

Collective Bargaining:

As collective bargaining negotiations with UTAS continue, the university has indicated that they are not in a position to offer any salary increases other than the 4% administrative pay rise already granted. Negotiations at other institutions have not only resulted in agreed outcomes in relation to improved conditions but have also delivered substantial salary increases.

 

Examples of agreed salary increases are:

 

Deakin                  17.1% with an agreement end date of 30 June 2012

 

Sydney                 18.3% with an agreement end date of May 2012

 

Negotiations are heading towards a conclusion at Swinburne , RMIT, Victoria and La Trobe University. All have agreed on the major claims similar to ours, while UTAS continues to bargain in bad faith and not address our core log of claims. Additional information about the collective bargaining state of play at other institutions can be found in the latest copy of Advocate, the Journal of the NTEU.

 

Upcoming Meetings:

Meetings for members will be called in the near future to provide updates on collective bargaining as well as considering our next course of action.

Meetings will be held on all 3 campuses, either in face or via video conference. Additional meetings at smaller outlying sites will also be held.

Dates and venues will be advised for the meeting to be held in early March shortly.
