NTEU MEMBERS HAVE VOTED TO STOP WORK FOR 24 HOURS, THIS THURSDAY 21 MAY

JOIN THE DAY OF ACTION TO GET RESPECT AT WORK FROM UTAS MANAGEMENT

Dear NTEU member,

Firstly, I would like to thank you for your overwhelming support of our industrial campaign. The ballot for protected industrial action conducted by the Australian Electoral Commission saw thehighest participation rate in the country. All actions on the ballot paper were strongly supported by our members. Only a handful of voters said no to all forms of action, a truly outstanding result.

There can be no doubt that you, the members, have been angered and frustrated by the lack of respect shown to staff through the deliberate stalling tactics of senior management over the past

12 months for a new collective agreement. At the state-wide members meeting held last Friday, our members heard a report from the bargaining team. Our team had met with management on the previous day, and were unable to report any significant progress in our claims. The membership then voted to ratify the actions expressed in the ballot and have declared a 24-hour strike for Thursday 21 May.

The door remains open to UTAS management to come to the table and bargain in good faith.

“Protected industrial action” means that members are legally protected against any disciplinary orlegal action. You cannot be discriminated against, threatened or fined for stopping work; however, you will not be paid for work not performed. NTEU will ensure that all members are afforded their protections and legal rights.

Please don’t just stop work on 21 May. Attend one of our peaceful protest lines to be held from 8:00 am, followed by a BBQ at 12:00 noon, to send a loud clear message to UTAS management.

Hobart: Walkway outside Morris Miller Library

Launceston: Turning circle opposite Raymond Ferrall Centre

If you work at another UTAS site  please attend your nearest

venue.

Thank you for your continued support to resolve our collective bargaining claims and to get

respect at work for all staff at UTAS.

In unity,

Kelvin Michael

President, NTEU Tasmanian Division

UTAS Joint Consultative Committee (Academic)

A meeting of the UTAS JCC (Academic) was held on Friday 19 December 2008 to discuss a Workplace Change Proposal for the School of English, Journalism and European Languages.

The following information relates to the meeting;

  • The consultation period about the proposed change was extended several times.
  • A decision on the change proposal has not been made yet.
  • Staff representatives Kelvin Michael and Andrew Fluck expressed disappointment that Professor Ralph Crane was not at the meeting to clarify ambiguities within the proposal.
  • Student involvement in workplace change proposal: It was suggested that barring students representatives from consultation meetings has had a negative effect upon the process. The JCC was divided on the involvment of the TUU and/or UTAS Teaching and Learning Committee during the early stage of workplace change proposals
  • 2009 enrollments in Medieval Studies units will be honoured as no decision on the proposed workplace change has been made. If the ultimate decision is made t discontinue the units, students will be counselled into alternatives.
  • It was suggested that the number of Schools budgeting more than 90% of their expenditure for profile staff in 2009 be identified through the UTAS Budget Committee.
  • Subsequent to the JCC receiving this information, such Schools may be asked if they will be considering a Change Management Process.

Education Faculty Workloads Dispute

On 30 June 2008,at the Supreme Court in Launceston, UTAS management met with the NTEU for dispute conciliation before Commissioner Whelan. The NTEU put up a strong and robust case that members would be proud of. Matters discussed included the 75/39 hours teaching preparation allowance; planning for the 40%-40%-20% teaching-research-other aspirational goal; identifying overwork; progression for early career academics; and the process for review of the current academic workload model.

Through the conciliation process we understand that agreement was achieved with management as follows:

1. Personal work overloads

This is an individual matter to be dealt with by the Faculty of Education workload allocation review committee (FEWARC). Management stated they were concerned about the potential impact of overwork on staff. They encourage staff that felt overloaded to apply for consideration to FEWARC. The union can and will support any member through this process. The Dean has undertaken to identify any additional performance management guidelines that can help clarify workload calculations.

2a. Workload model review panel

The current process underway will be scrapped. A new Workload Model Review Panel will be formed with equally balanced management and staff representation (three performance managers and three elected staff members). The NTEU is free to nominate representatives for election. This should happen very quickly.

2b.The new Workload Model Review Panel will consider some high priority flagged items at an early stage, and matters unresolved by the Dispute Resolution process including:

Preparation time for teaching (75 hours or 39 hours, NRP2a). We have asked that any change should be applied to workloads from the start of 2nd semester, 2008.

Planning to achieve the 40-40-20 aspiration

Progression for early career academics

Journal editorial board allocation (50 or 20 hours, NRP13)

Staff working on the Workload Model Review Panel will have a suitable time allowance, and will consult widely with staff. The Review Panel will be required to finalise its report to the Dean by the 15th of September.

The NTEU has the ability to bring the case back to the commissioner it is not satisfied with the Review Panel report. The NTEU can also explore with members the taking of protected industrial action if appropriate (this was not allowed to prior to the 30th of June under the terms of existing enterprise bargaining agreement).

COLLECTIVE BARGAINING

UTas management attempts to manipulate who’s on the NTEU bargaining team.

As part of negotiating a new enterprise agreement for UTas staff, NTEU have begun bargaining with UTas management for improvements in casual staff conditions, including paid marking, 25% loading, parking permits, career paths and resources etc. We are pursuing claims for general and academic casual staff.

To assist in the process, we arranged for a casual academic member to attend a bargaining meeting scheduled for today, and received confirmation that a video-conference facility in Launceston had been made available to enable the casual member’s participation.

Prior to the meeting this morning, the NTEU office was advised by telephone that Mr Stuart Andrews had decided that it was inappropriate that other people attend the bargaining meeting.

NTEU maintains that we should not be dictated to by University management about who is on our bargaining team. We had no choice but to cease the meeting without the presence of our casual nominee.

The notion that the NTEU would, where appropriate, include different members on the EB team for specific discussions had been aired at an earlier EB meeting, and no objection had been flagged by UTas management.

The NTEU operates in a democratic manner, and we insist on the right to formulate our bargaining team for each meeting as we see fit. We fully intend to bring in members with particular expertise for certain topics of discussion.

Thus far, we have sought to conduct our side of the enterprise bargaining process in good faith. We look forward to an assurance that UTas management is prepared to do likewise.

NTEU has written to the Vice Chancellor today, protesting at this action by UTas management. We will keep you informed on further developments.
