Deeming of Academic Leave

As a consequence of the coming into effect of the Fair Work Act the provisions of the VU EBA dealing with deeming of academic leave are no longer enforceable.

HR have been advised of section 55 of the FW Act which pertains and we have been advised by the Director HR that VU has taken action to stop any action on deeming.

The effect of that is that there is no longer any capacity on the part of the University to force academic staff to take annual leave.

Nevertheless, we would encourage you to take leave annually in the interests of health and wellbeing.
