Misconduct Allegations
In the late 1980s, NTEU’s predecessor academic unions renegotiated special procedures for dealing with allegations of misconduct by academic staff.
At a number of institutions these protections have been extended to general staff, and at some other institutions there are provisions specifically for general staff. You should look at the Agreement which applies to you to determine the applicable procedures.
If you are ever charged with misconduct or it is suggested that your employment may be terminated due to misconduct, contact the Union immediately. Usually, you will have a right to have a witness at any meeting with management to discuss performance – you should use this right.
If you have been dismissed for alleged misconduct, you may have a right to challenge the dismissal in Fair Work Australia. You should contact the NTEU immediately as time limits apply.
